1. Accepting these terms

These Terms of Service are a binding agreement between you and PUFF JOURNEY LTD ("Bagged", "we", "us") and govern your use of the Bagged iOS app and the services behind it (together, the "Service").

By downloading, signing in to or using Bagged you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Who can use Bagged

You must be at least 13 years old to use Bagged. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian, who agrees to these terms on your behalf.

You must not use the Service if you are barred from doing so under the laws of your country or of the United Kingdom, the European Union or the United States.

3. Your account

You can use Bagged with an anonymous account, or by signing in with Apple or Google. You are responsible for activity that happens under your account.

An anonymous account is tied to that installation. If you delete the app, lose the device or sign out, an anonymous account and everything in it may be permanently unrecoverable. Link your account to Apple or Google if you want to keep your collection.

Usernames must comply with section 9. We may reclaim a username that impersonates someone, infringes a trade mark, or breaches those standards.

You may delete your account at any time from within the app. Deletion is permanent and removes your collection, cards, photos and scores. You will find it at Profile → Settings → Delete account.

4. Licence to use the app

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Bagged on Apple-branded devices that you own or control, in accordance with these terms and the Usage Rules in the Apple Media Services Terms and Conditions. We reserve every right not expressly granted.

5. Wildlife and your own safety

Bagged asks you to go outside and photograph animals. That carries real risk, and this section matters more than any other in this document.

You are responsible for your own safety. Pay attention to your surroundings. Do not use the app while driving, cycling or crossing roads. Do not enter water, cliffs, tidal areas, railway land or any other hazardous place to make a catch.

Do not trespass. Only photograph from places you are lawfully entitled to be. Respect private property, access restrictions, nature reserve rules and seasonal closures.

Do not disturb, bait, chase, handle, trap or harm any animal in order to photograph it. Do not disturb nests, dens, setts, roosts or breeding sites. In many countries this is a criminal offence, particularly for protected species — including, in the UK, offences under the Wildlife and Countryside Act 1981.

Keep your distance from animals that can hurt you. No card is worth an injury.

Never rely on Bagged to tell you whether something is safe. The species identification is produced by an automated system and is often wrong. Do not use it to decide whether an animal is venomous, aggressive, protected, or safe to approach, touch or eat. It is a game, not a field guide, and not a substitute for expert advice.

You are solely responsible for complying with all local laws on wildlife, photography, drones, access and privacy where you are.

Bagged is a game about actually going and finding animals. Scores mean nothing if they can be faked, so we check.

We use automated checks — including Apple's App Attest, image hashing, timing checks and captivity and screen detection — to identify submissions that break these rules. Where we find them we may reject the catch, remove awarded Bounty or Quest Points, reset a collection, or suspend or terminate the account. Catches made in zoos, aquariums and wildlife parks may be scored differently or not at all; that is a game design decision, not an accusation.

8. Your content

"Your Content" means the photographs, usernames, card nicknames and anything else you submit to the Service.

You keep ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt, resize, publish and display Your Content for the purposes of operating, improving and promoting the Service — including displaying your cards to other users and processing your photographs through our third-party identification providers as described in the Privacy Policy.

This licence ends when you delete the content or your account, except that we may retain backup copies for a limited period and may keep copies where the law requires. We do not use your photographs in advertising or marketing.

You confirm that you took, or have the right to submit, everything you upload, and that it does not infringe anyone's rights.

Be aware that cut-out card images are served from public URLs. Anyone with the link can view them.

9. Content standards

Your Content, including your username and card nicknames, must not contain or depict:

There is no tolerance for objectionable content or abusive users. We may remove any content and terminate any account that breaches these standards, without notice.

10. Reporting and blocking

If someone behaves badly you can block them from your friends list, which immediately stops them seeing your collection or contacting you again. To report content or behaviour to us, email baggedsupport@gmail.com.

We review every report and aim to act within 24 hours, removing offending content and ejecting the user who provided it where a report is upheld.

You can block any account from its profile. Blocking prevents that account from seeing your profile, your collection or your cards, and from sending you friend requests.

Blocking takes effect at once and works in both directions: a blocked account cannot see your collection, send you a friend request, or reach your profile from a leaderboard, a shared code or a search.

11. Cards, Bounty and Quest Points

Cards, Bounty, Quest Points, crowns, collector ranks and serial numbers are features of a game. They have no monetary value, are not property, are not currency, and cannot be exchanged for money or anything of value. You have no ownership interest in them.

They are not transferable between accounts and may not be sold or traded. We may change, rebalance, reset or withdraw any of them, including scoring rules and rarity tiers, as part of running and balancing the game.

Releasing a card removes it from your collection. The serial number recording that the species was caught is retained and is never reissued.

12. Purchases and subscriptions

Bagged is free to play. It also offers an optional paid upgrade, Bagged+, available as a weekly or yearly subscription or as a one-off lifetime purchase. The free tier includes a limited number of catches; Bagged+ removes that limit and unlocks saving stickers and photos.

Any purchase is made through Apple, under Apple's payment terms, and is managed for us by RevenueCat. Prices are shown before you buy. Subscriptions renew automatically until cancelled, and you cancel through your Apple ID settings rather than through us.

Refunds are handled by Apple, not by us. If you are a consumer in the UK or EU you normally have a 14-day right to cancel digital purchases, which you can lose once delivery of the content begins with your consent.

Anything you unlock by paying is a licence to use it inside Bagged. It has no cash value, cannot be sold or transferred, and does not survive the deletion of your account.

13. Beta software

Bagged is currently distributed as a pre-release beta through TestFlight. Beta software is incomplete and may contain errors. Features may change or disappear, and your account, collection and progress may be reset without notice. Beta use is subject to Apple's TestFlight terms as well as these terms.

14. Changes and availability

We may change, suspend or discontinue any part of the Service at any time, and we do not guarantee it will be available, uninterrupted or error-free. We may impose limits on usage, storage or scanning to keep the Service running.

Bagged depends on services we do not control, including Apple's, our hosting provider's and our identification provider's. Their outages are not within our control.

15. Suspension and termination

We may suspend or terminate your access immediately if you breach these terms, if we are required to by law, or if we reasonably believe your use harms the Service or other users. Where it is reasonable to do so, we will tell you why and give you a way to respond.

You may stop using the Service and delete your account at any time. Sections 8, 11, 16 and 18 to 22 survive termination.

16. Our intellectual property

The Bagged name, logo, app, card designs, artwork, silhouettes, text, rarity system and all other material we provide are owned by us or our licensors and protected by intellectual property law. Nothing in these terms transfers any of it to you.

Species data is derived in part from the Global Biodiversity Information Facility (GBIF) and is used under its terms. Species descriptions may derive from third-party sources under their own licences. Our sources and their licences are listed in full on our credits page.

17. Third-party services

The Service uses third-party providers for hosting, authentication, species identification, analytics, attribution, purchases and maps. Your use of the Service is also subject to their terms where they apply, and we are not responsible for their acts or omissions. Map data is provided by Apple Maps and is subject to Apple's terms.

18. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.

We do not warrant that species identifications are accurate. They are produced by automated systems that make mistakes. Do not rely on them for any purpose where being wrong matters — including safety, health, conservation, scientific, commercial or legal purposes.

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, you have statutory rights that these terms do not affect.

19. Apple-specific terms

These terms are between you and us alone, not with Apple. The following apply to your use of Bagged on Apple devices, and Apple requires them:

  1. Not a party. Apple is not a party to these terms and is not responsible for Bagged or its content.
  2. Licence scope. Your licence to use Bagged is limited to a non-transferable licence to use it on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  3. Maintenance and support. We are solely responsible for providing any maintenance and support for Bagged. Apple has no obligation whatsoever to furnish any maintenance or support services.
  4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Bagged fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Bagged.
  5. Product claims. We, not Apple, are responsible for addressing any claims relating to Bagged, including product liability claims, any claim that Bagged fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
  6. Intellectual property claims. If a third party claims that Bagged infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
  7. Legal compliance. You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
  8. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, have the right (and are deemed to have accepted the right) to enforce them against you.

20. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill, or your collection or progress, however caused.

Our total liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or £50.

This section does not limit liability that cannot lawfully be limited, and does not affect the statutory rights of consumers.

21. Indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms, your misuse of the Service, Your Content, or your infringement of anyone else's rights. This does not apply to the extent the claim arises from our own breach or negligence, and it does not apply to consumers where the law does not permit it.

22. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

If you are a consumer resident in the EU or UK, you keep the protection of the mandatory laws of the country you live in, and you may bring proceedings there.

23. Changes to these terms

We may update these terms. If a change is material we will give you reasonable notice in the app before it takes effect. Continuing to use the Service after that means you accept the new terms; if you do not, stop using the Service and delete your account.
